為進一(yi)步加大力度(du)推動發用電(dian)計劃放開,完善價格形(xing)成機制國家(jia)發展和改革委員會(以下簡稱國家(jia)發改委)、國家(jia)能源局近日(ri)聯(lian)合出臺文件(jian),選擇煤(mei)炭(tan)、鋼(gang)鐵、有(you)色、建材4個(ge)行業全面放開發用電計劃。

據(ju)悉,為深化(hua)供(gong)給側結構性改(gai)革,進(jin)一(yi)步(bu)完善(shan)要素(su)市場化(hua)配置,推(tui)進(jin)電(dian)(dian)力(li)體(ti)制(zhi)(zhi)改(gai)革,國家發改(gai)委、國家能源(yuan)局近日聯合出臺了《關(guan)于積極(ji)推(tui)進(jin)電(dian)(dian)力(li)市場化(hua)交易(yi) 進(jin)一(yi)步(bu)完善(shan)交易(yi)機制(zhi)(zhi)的通知(zhi)(zhi)》(以下簡(jian)稱《通知(zhi)(zhi)》),并配發了《全面(mian)開放部分(fen)重(zhong)點行業電(dian)(dian)力(li)用戶發電(dian)(dian)用電(dian)(dian)計劃實施(shi)方案》(以下簡(jian)稱《實施(shi)方案》)。

據(ju)統計,2017年(nian),各地簽訂(ding)直(zhi)接交(jiao)(jiao)易(yi)年(nian)度(du)(du)、月度(du)(du)合(he)同以及平(ping)(ping)臺(tai)集中(zhong)交(jiao)(jiao)易(yi)合(he)同電(dian)量(liang)(liang),加(jia)上跨省區(qu)市(shi)場(chang)化(hua)交(jiao)(jiao)易(yi)、發電(dian)權(quan)交(jiao)(jiao)易(yi)等其他交(jiao)(jiao)易(yi)品種(zhong),累計完成市(shi)場(chang)化(hua)交(jiao)(jiao)易(yi)電(dian)量(liang)(liang)1.63萬(wan)億千(qian)瓦時(shi),同比(bi)增(zeng)長45%,占(zhan)全社會(hui)用電(dian)量(liang)(liang)比(bi)重約(yue)26%,度(du)(du)電(dian)平(ping)(ping)均(jun)降價約(yue)5分。2018年(nian)上半年(nian),各地繼續組織電(dian)力市(shi)場(chang)化(hua)交(jiao)(jiao)易(yi),不斷創新和豐富交(jiao)(jiao)易(yi)品種(zhong)形式,積(ji)極培育市(shi)場(chang)主體(ti),市(shi)場(chang)化(hua)交(jiao)(jiao)易(yi)電(dian)量(liang)(liang)累計突(tu)破8000億千(qian)瓦時(shi),同比(bi)增(zeng)長24.6%。據初步(bu)分(fen)析(xi),4個行業用(yong)戶全面放(fang)開(kai)后(hou)可(ke)增加市(shi)場化(hua)交(jiao)易(yi)電(dian)量(liang)(liang)3500億(yi)千(qian)瓦時,可(ke)以(yi)使(shi)市(shi)場化(hua)交(jiao)易(yi)電(dian)量(liang)(liang)占全社會(hui)用(yong)電(dian)量(liang)(liang)的比例(li)提高5個百分(fen)點,能夠顯著推動我(wo)國(guo)電(dian)力市(shi)場化(hua)改(gai)革進(jin)程(cheng)。更為(wei)重要(yao)的是,通過行業全部放開發(fa)用電計劃試點,能夠探索出一條分行業逐(zhu)步擴大市(shi)場化(hua)范圍的改革(ge)(ge)路徑(jing),真正實(shi)現電力市(shi)場化(hua)改革(ge)(ge)穩妥和積極的推進。

《通知》和《實施(shi)方案》的指導思想、意義

《通(tong)知》和《實(shi)施(shi)方案》以習近平新(xin)時代中國特色社會(hui)主義思想為指導(dao),深入貫徹黨的十九大和十九屆(jie)二中、三中全會(hui)精神,全面(mian)落實(shi)中央經濟工作會(hui)議(yi)部署,加快推進(jin)電力(li)市場化(hua)(hua)交易(yi),擴大市場主體(ti)參與(yu),完(wan)善直(zhi)接交易(yi)機制(zhi),深化(hua)(hua)電力(li)體(ti)制(zhi)改(gai)革。

《通知》提出進一(yi)步加大(da)力度推動發用(yong)電(dian)(dian)(dian)計劃放(fang)開,發電(dian)(dian)(dian)側除了清潔能源、調節性(xing)電(dian)(dian)(dian)源等(deng)優先發電(dian)(dian)(dian)之外,用(yong)戶側除了居民、農業、重要(yao)公用(yong)事業和(he)公益(yi)性(xing)服務等(deng)優先購電(dian)(dian)(dian)之外,其他經(jing)營性(xing)的發用(yong)電都應放開,同時積極鼓(gu)勵(li)符(fu)合條件的優先發電企業、優先購電用(yong)戶參(can)與市場。同時,《通知》提出(chu)了以完善市場化交(jiao)易價格調整機制為核心的一整套相關機制設(she)計,確(que)保電(dian)力市場化交(jiao)易的有序、規范,實現改(gai)革(ge)平穩推進。

為進(jin)一步出實招、硬(ying)招,確保(bao)電(dian)(dian)(dian)力(li)(li)市(shi)(shi)場化交易比重有(you)(you)明(ming)顯(xian)提高,決定(ding)選擇煤(mei)炭、鋼鐵(tie)、有(you)(you)色、建(jian)材4個(ge)行業(ye)電(dian)(dian)(dian)力(li)(li)用戶(hu),率先全面放開(kai)發用電(dian)(dian)(dian)計劃(hua)試(shi)點,進(jin)一步擴大交易規模,完善交易機制(zhi)(zhi),形(xing)(xing)成(cheng)新的(de)(de)改(gai)(gai)革(ge)突破口和著力(li)(li)點,并據此制(zhi)(zhi)定(ding)了(le)(le)《實施方案》。這(zhe)4個(ge)行業(ye)市(shi)(shi)場化程度較(jiao)高,在電(dian)(dian)(dian)力(li)(li)體(ti)制(zhi)(zhi)改(gai)(gai)革(ge)過(guo)程中已經參與了(le)(le)市(shi)(shi)場化交易,市(shi)(shi)場意識較(jiao)強,市(shi)(shi)場經驗(yan)豐(feng)富(fu),試(shi)點全面放開(kai)發電(dian)(dian)(dian)用計劃(hua)具有(you)(you)較(jiao)好的(de)(de)基礎。通(tong)(tong)過(guo)先行先試(shi),有(you)(you)利于充分(fen)還原電(dian)(dian)(dian)力(li)(li)商品屬性,理順和打通(tong)(tong)電(dian)(dian)(dian)力(li)(li)及其(qi)上(shang)下游行業(ye)的(de)(de)價(jia)格市(shi)(shi)場化形(xing)(xing)成(cheng)機制(zhi)(zhi),形(xing)(xing)成(cheng)全產業(ye)鏈價(jia)格聯動、利益共享(xiang)、風險(xian)共擔(dan)協同(tong)發展(zhan)格局,進(jin)而有(you)(you)效促進(jin)社會主義市(shi)(shi)場經濟(ji)的(de)(de)平穩健康運(yun)行。

《通知(zhi)》和《實施方案(an)》的(de)具體要求

《通知》提出了(le)9條(tiao)具體(ti)要求:

一是各地(di)加快放開發用(yong)電(dian)計劃,大幅提高交(jiao)(jiao)易(yi)(yi)電(dian)量規(gui)模,進(jin)一步擴(kuo)大市場(chang)主體范圍(wei),進(jin)一步明(ming)確放開各類發電(dian)企業、用(yong)戶(hu)進(jin)入市場(chang)的(de)時(shi)間(jian),明(ming)確放開比例,鼓勵(li)跨省跨區(qu)網(wang)對網(wang)、網(wang)對點(dian)交(jiao)(jiao)易(yi)(yi),對有條件的(de)地(di)區(qu)有序支持點(dian)對網(wang)、點(dian)對點(dian)交(jiao)(jiao)易(yi)(yi),支持用(yong)戶(hu)與清潔能源開展交(jiao)(jiao)易(yi)(yi)。

二是發電方面,除煤電機組外(wai),推進水電、風電、太(tai)陽能發電、核電、分布(bu)式發電等進入市場。

三是用(yong)戶(hu)(hu)方面(mian),進(jin)(jin)一步放開(kai)用(yong)戶(hu)(hu)電壓(ya)等(deng)級限制,10千伏(fu)及以上電壓(ya)等(deng)級用(yong)戶(hu)(hu)都(dou)可進(jin)(jin)入市場,積極支持用(yong)電量大的工(gong)商(shang)業(ye)、新興(xing)產業(ye)、工(gong)業(ye)園區、公共服務行業(ye)等(deng)用(yong)戶(hu)(hu)進(jin)(jin)入市場。

四是售電企業(ye)方(fang)面,鼓勵售電公司擴(kuo)大(da)業(ye)務范圍,靠(kao)降(jiang)低成(cheng)本和提供(gong)增值服(fu)(fu)務參與競爭,支(zhi)持供(gong)水、供(gong)氣、供(gong)熱等公共(gong)服(fu)(fu)務行業(ye)和節能服(fu)(fu)務公司從(cong)事售電業(ye)務。

五是完善市(shi)場主(zhu)體注冊制(zhi),進入市(shi)場的(de)發電(dian)企業、用戶和售電(dian)公司等(deng)都要完成注冊程(cheng)序,成為(wei)合(he)格市(shi)場主(zhu)體。

六是規范市場主體交易行為,要(yao)(yao)求市場主體按照交易規則(ze)參與各(ge)類交易,通過市場競爭形(xing)成價格,接受(shou)政府有(you)關部門監管。同時(shi)明(ming)確要(yao)(yao)求各(ge)地有(you)關部門要(yao)(yao)最(zui)大限(xian)度減少對微觀事(shi)務的干預。

七是完善中長(chang)期(qi)合同交(jiao)易(yi)電量價(jia)(jia)格(ge)(ge)(ge)調(diao)整機制,交(jiao)易(yi)雙方在自(zi)(zi)主自(zi)(zi)愿、平等(deng)協商的基(ji)礎上,在合同中約定建(jian)立固定價(jia)(jia)格(ge)(ge)(ge)、“基(ji)準電價(jia)(jia)+浮動機制”、隨電煤(mei)價(jia)(jia)格(ge)(ge)(ge)、產品價(jia)(jia)格(ge)(ge)(ge)聯動或隨其他因素(su)調(diao)整等(deng)多種形式的市場價(jia)(jia)格(ge)(ge)(ge)形成機制。

八是(shi)加強事(shi)中(zhong)事(shi)后監管,建立(li)健全交易合(he)同糾紛協調(diao)仲裁機制,保障(zhang)電力市場健康運行。

九是推進(jin)電力(li)市場主體信(xin)用建設,開展信(xin)用評價,實施守信(xin)聯(lian)合(he)激勵和失信(xin)聯(lian)合(he)懲戒。

《實(shi)施方案》提出(chu)了(le)6條具體要(yao)求:

一(yi)是強調了(le)放(fang)開煤(mei)炭、鋼鐵、有色(se)、建材(cai)等4個行業電力(li)用(yong)戶發用(yong)電計劃的重(zhong)要意義,明確(que)了(le)“應(ying)放(fang)盡放(fang)”等基本原則。二(er)是試點全部放開(kai)(kai)4個行業發(fa)(fa)(fa)用電(dian)(dian)計(ji)劃(hua)(hua),用戶(hu)(hu)全電(dian)(dian)量參(can)與(yu)交(jiao)易(yi),具備(bei)條件的同步(bu)放開(kai)(kai)發(fa)(fa)(fa)用電(dian)(dian)計(ji)劃(hua)(hua)和(he)電(dian)(dian)價,由用戶(hu)(hu)和(he)發(fa)(fa)(fa)電(dian)(dian)企業自主協商確(que)定(ding)供電(dian)(dian)方式和(he)價格(ge)機制,逐(zhu)步(bu)放開(kai)(kai)參(can)與(yu)跨省跨區交(jiao)易(yi)限(xian)制,支持用戶(hu)(hu)與(yu)清潔能源開(kai)(kai)展(zhan)市(shi)場(chang)化交(jiao)易(yi)。三是(shi)(shi)做好放開發(fa)用(yong)電計(ji)劃和推(tui)進市場(chang)(chang)(chang)化交(jiao)易有效銜接,用(yong)戶(hu)和發(fa)電企(qi)業(ye)無法協商(shang)(shang)一致的,可(ke)先(xian)放開發(fa)用(yong)電計(ji)劃,用(yong)戶(hu)價(jia)格(ge)暫按當(dang)地(di)目(mu)錄(lu)電價(jia)標準確定。四(si)是(shi)(shi)建(jian)立完善科學(xue)合(he)(he)(he)理的市場(chang)(chang)(chang)化價(jia)格(ge)形(xing)成機制,用(yong)戶(hu)和發(fa)電企(qi)業(ye)簽(qian)訂合(he)(he)(he)同時(shi)自(zi)主協商(shang)(shang),約定建(jian)立“基(ji)準電價(jia)+浮動(dong)機制”的市場(chang)(chang)(chang)化價(jia)格(ge)形(xing)成機制,明確“基(ji)準電價(jia)”和“浮動(dong)機制”的協商(shang)(shang)原則(ze),繼續支持資源(yuan)綜合(he)(he)(he)利(li)用(yong)和落實懲罰性(xing)電價(jia)。五是(shi)(shi)規范4個行業(ye)用(yong)戶(hu)交(jiao)易行為,推(tui)進簽(qian)訂中長期合(he)(he)(he)同。六是(shi)(shi)進一步(bu)加強事中事后監(jian)管,保障(zhang)合(he)(he)(he)同執行。

下一步落實(shi)《通知》和(he)《實(shi)施(shi)方案》的工作重(zhong)點

一是整(zheng)體放開。統一思想認識,進一步(bu)擴大市場主體范圍和規模,進一步(bu)完善交(jiao)(jiao)易(yi)(yi)機制,形成新的(de)改革突(tu)破口和著力(li)點(dian)。2018年先放(fang)開(kai)4個(ge)行業電(dian)(dian)力(li)用(yong)(yong)(yong)戶(hu)(hu),全電(dian)(dian)量參與交(jiao)(jiao)易(yi)(yi),通過交(jiao)(jiao)易(yi)(yi)滿(man)足用(yong)(yong)(yong)電(dian)(dian)需求。指導各地(di)成立(li)專項工作組,研究制定(ding)本地(di)4個(ge)行業全部(bu)放(fang)開(kai)發用(yong)(yong)(yong)電(dian)(dian)計劃(hua)實(shi)施方(fang)案,明確目標任務,列出詳(xiang)細(xi)時間表(biao)和路(lu)線圖,確保4個(ge)行業用(yong)(yong)(yong)戶(hu)(hu)發用(yong)(yong)(yong)電(dian)(dian)計劃(hua)整體放(fang)開(kai)。

二是兜底保供。在改革推進(jin)過程中,務必堅(jian)持積極穩妥的(de)(de)(de)原則,保(bao)障用(yong)戶(hu)安(an)(an)全可靠(kao)供(gong)(gong)(gong)電(dian)(dian)不受影響,決(jue)不允許因(yin)進(jin)入電(dian)(dian)力市場(chang)而導致(zhi)用(yong)戶(hu)供(gong)(gong)(gong)電(dian)(dian)中斷的(de)(de)(de)情況發(fa)生。電(dian)(dian)網企業要承(cheng)擔保(bao)底供(gong)(gong)(gong)電(dian)(dian)責任,對(dui)暫未能(neng)與發(fa)電(dian)(dian)企業簽(qian)訂直接交易合同(tong)的(de)(de)(de)電(dian)(dian)力用(yong)戶(hu),以及已參(can)加市場(chang)化交易又退(tui)出的(de)(de)(de)電(dian)(dian)力用(yong)戶(hu),提供(gong)(gong)(gong)保(bao)底供(gong)(gong)(gong)電(dian)(dian)服務,并(bing)按照(zhao)相(xiang)關政策規定收取(qu)電(dian)(dian)費。要科學安(an)(an)排(pai)發(fa)電(dian)(dian)機組(zu)的(de)(de)(de)發(fa)電(dian)(dian)計(ji)劃放開進(jin)度,合理設計(ji)有(you)效(xiao)過渡機制(zhi),對(dui)于發(fa)電(dian)(dian)機組(zu)承(cheng)擔電(dian)(dian)網安(an)(an)全、保(bao)障用(yong)戶(hu)用(yong)電(dian)(dian)所需的(de)(de)(de)發(fa)電(dian)(dian)量,按照(zhao)優先發(fa)電(dian)(dian)制(zhi)度,原則上(shang)按照(zhao)基數安(an)(an)排(pai)發(fa)電(dian)(dian)計(ji)劃,保(bao)障電(dian)(dian)網安(an)(an)全穩定運行(xing)和用(yong)戶(hu)可靠(kao)供(gong)(gong)(gong)電(dian)(dian)。

 

三是三方簽約。創(chuang)造有(you)利條件,鼓(gu)勵進(jin)入(ru)市(shi)場(chang)的(de)(de)(de)發(fa)(fa)電(dian)(dian)企(qi)(qi)業(ye)(ye)和電(dian)(dian)力(li)(li)(li)(li)用(yong)(yong)(yong)(yong)戶,抓緊簽(qian)(qian)訂包含(han)發(fa)(fa)電(dian)(dian)、用(yong)(yong)(yong)(yong)戶、電(dian)(dian)網企(qi)(qi)業(ye)(ye)三方(fang)的(de)(de)(de)市(shi)場(chang)化交(jiao)易(yi)合(he)(he)(he)同(tong)(tong),鼓(gu)勵簽(qian)(qian)訂中(zhong)長(chang)期合(he)(he)(he)同(tong)(tong),穩定(ding)市(shi)場(chang)預期,有(you)效(xiao)平(ping)抑價格波動。要求(qiu)各地政府(fu)主管部門會(hui)同(tong)(tong)交(jiao)易(yi)機構,抓緊銜接(jie)目前4個行(xing)業(ye)(ye)中(zhong)暫未進(jin)入(ru)市(shi)場(chang)的(de)(de)(de)用(yong)(yong)(yong)(yong)戶與發(fa)(fa)電(dian)(dian)企(qi)(qi)業(ye)(ye),通過雙邊協商或集中(zhong)競價的(de)(de)(de)方(fang)式參(can)與市(shi)場(chang)化交(jiao)易(yi),由電(dian)(dian)力(li)(li)(li)(li)交(jiao)易(yi)中(zhong)心組(zu)織(zhi)好用(yong)(yong)(yong)(yong)戶與發(fa)(fa)電(dian)(dian)企(qi)(qi)業(ye)(ye)或售電(dian)(dian)公司的(de)(de)(de)合(he)(he)(he)同(tong)(tong)簽(qian)(qian)約工(gong)作,對(dui)(dui)于在規(gui)定(ding)時限內未能完成簽(qian)(qian)約的(de)(de)(de)用(yong)(yong)(yong)(yong)戶,由電(dian)(dian)力(li)(li)(li)(li)交(jiao)易(yi)中(zhong)心負(fu)(fu)責“兜底簽(qian)(qian)約”,保(bao)(bao)證4個行(xing)業(ye)(ye)放開發(fa)(fa)用(yong)(yong)(yong)(yong)電(dian)(dian)計劃(hua)用(yong)(yong)(yong)(yong)戶的(de)(de)(de)全覆蓋。對(dui)(dui)于小用(yong)(yong)(yong)(yong)戶,在沒有(you)落實(shi)(shi)直接(jie)交(jiao)易(yi)合(he)(he)(he)同(tong)(tong)的(de)(de)(de)情況下(xia),電(dian)(dian)網公司可以代購代銷。對(dui)(dui)于參(can)與跨省區直接(jie)交(jiao)易(yi)的(de)(de)(de)電(dian)(dian)力(li)(li)(li)(li)用(yong)(yong)(yong)(yong)戶和發(fa)(fa)電(dian)(dian)企(qi)(qi)業(ye)(ye),由北京電(dian)(dian)力(li)(li)(li)(li)交(jiao)易(yi)中(zhong)心和廣州(zhou)電(dian)(dian)力(li)(li)(li)(li)交(jiao)易(yi)中(zhong)心負(fu)(fu)責銜接(jie)簽(qian)(qian)約。指(zhi)導(dao)電(dian)(dian)力(li)(li)(li)(li)交(jiao)易(yi)機構切實(shi)(shi)發(fa)(fa)揮(hui)好第(di)三方(fang)核查(cha)作用(yong)(yong)(yong)(yong),保(bao)(bao)證交(jiao)易(yi)合(he)(he)(he)同(tong)(tong)的(de)(de)(de)真實(shi)(shi)性和有(you)效(xiao)性。
